Individual Practices Override Default Rules
Individual judges maintain their own practices that can override default briefing schedules (Rule 6.1 introduction) and motion procedures (Rule 7.1(e)). Always check the assigned judge's individual rules before filing.
Key areas where individual practices commonly diverge from the local rules:
- Briefing schedules -- judges may set different response and reply deadlines
- Letter-motions -- some judges authorize substantive motions by letter; others strictly limit letters to extensions, adjournments, and premotion conferences (Rule 7.1(e))
- Pre-motion conferences -- some judges require conferences before any dispositive motion, beyond the Rule 37.2 requirement for discovery disputes
Division of Business Rules (Rule 1.1)
Each district (SDNY and EDNY) has separately adopted Division of Business Rules governing case assignment and related administrative matters.
